1. About us
These Terms and Conditions apply to purchases made through the TÓLME online store at thetolme.com (the “Store”).
The Store is operated by:

TÓLME is the trading name used for the Store. The Store is hosted by Shopify, but all sales contracts are concluded directly between you and Rédey Viktoria Desirée e.v.
2. Scope
These Terms apply to all orders placed by consumers through the Store. A consumer is a natural person acting for purposes that are outside their trade, business, craft or profession.
By placing an order, you confirm that you are at least 18 years old or otherwise legally capable of entering into a binding contract.
Any mandatory consumer rights available to you under the law of your country of residence remain unaffected by these Terms.
3. Product information
We take reasonable care to describe and present our products accurately. Product photographs, colours and finishes may nevertheless appear slightly different depending on screen settings, lighting and photography.
Product measurements are approximate. Minor variations that do not materially affect the product’s appearance or function may occur.
The relevant product page forms part of these Terms and contains the product’s principal characteristics, price and any product-specific care or safety information.
4. Prices
All prices are shown in euros (€). The price payable is the price displayed at checkout when the order is placed.
TÓLME is currently operated by a Hungarian VAT-exempt sole proprietor. No VAT is charged unless otherwise stated or required by applicable law.
Delivery charges are shown separately before you submit your order. For deliveries within the European Union, customers will not be charged customs duties or import fees by TÓLME at checkout unless expressly stated before purchase.
We may change prices at any time, but a change will not affect an order that we have already accepted.
5. Placing an order and conclusion of the contract
Products displayed in the Store are an invitation to place an order and do not constitute a binding offer by us.
By selecting the order button at checkout, you place a binding order for the products in your cart and agree to pay the total amount displayed.
After placing an order, you will receive an automatic acknowledgement by email. This acknowledgement confirms that we have received your order but does not yet constitute acceptance.
The sales contract is concluded when we send you an order confirmation or dispatch confirmation, whichever occurs first. We reserve the right to decline an order before acceptance, including where:

a product is unavailable;

payment cannot be authorised;

the information supplied is incomplete or appears incorrect or fraudulent;

a pricing or product-information error is evident; or
-
we cannot deliver to the address provided.
If payment has already been taken for an order that we cannot accept, we will refund the amount paid without undue delay.
Please check all order details carefully before submitting your order. If you notice an error, contact us promptly at hello@thetolme.com. We cannot guarantee that an accepted order can be changed or cancelled before dispatch; this does not affect your statutory right of withdrawal.
6. Payment
Available payment methods are displayed at checkout. Payment is due when the order is placed.
You confirm that you are authorised to use the payment method supplied and that all billing information is complete and accurate. Payment services may be provided by third-party payment processors under their own terms and privacy notices.
7. Delivery
We currently deliver to countries within the European Union.
Orders are normally prepared and dispatched within 1–3 working days. For orders placed before 2:00 pm Central European Time on a working day, we aim to dispatch the order on the same working day. Same-day dispatch is an aim rather than a guarantee.

The carrier used may vary where operationally necessary. Any estimated transit time shown in the Store, at checkout or in our Shipping Policy begins after dispatch and is an estimate only. We will deliver within the timeframe agreed with you or, where no different timeframe has been agreed, no later than 30 days after conclusion of the contract, except for clearly identified pre-order products.
We are not responsible for a delay caused by an event outside our reasonable control. If a material delay occurs, we will contact you and take reasonable steps to minimise its effect. Your mandatory rights relating to late or failed delivery remain unaffected.
Risk of loss or damage passes to you when you, or a third party designated by you other than the carrier, physically receive the product. If you independently appoint a carrier that was not offered by us, risk passes when the product is handed to that carrier.
Please provide a complete and accurate delivery address. Additional costs arising from an incorrect address, an unclaimed parcel or a delivery refusal may be charged to you where permitted by law, except where the refusal results from a valid exercise of your legal rights.
8. Pre-orders
A product described as a “pre-order” is not available for immediate dispatch. The expected dispatch date or delivery period will be shown on the relevant product page before purchase.
Pre-order dates are estimates and may change due to production or transport circumstances. If a substantial delay occurs, we will inform you. You may then retain the order or cancel the affected pre-order for a full refund.
If an order contains both available and pre-order products, they may be dispatched together when the pre-order product becomes available unless the Store states otherwise.
9. Statutory right of withdrawal
If you are a consumer in the European Union, you generally have the right to withdraw from the contract within 14 days without giving a reason.
For goods, the withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, physically receive the goods. If goods from one order are delivered separately, the period begins when the last item is received.
To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement before the withdrawal period expires. You may email us at hello@thetolme.com. Full withdrawal and return instructions are available in our Return & Refund Policy [LINK TO RETURN & REFUND POLICY].
After notifying us, you must return the goods without undue delay and no later than 14 days from the date on which you communicated your withdrawal.
Please contact us before returning a product so that we can provide the correct return instructions and return address. Do not send returns to the registered business address unless we expressly instruct you to do so.
You bear the direct cost of returning the goods, unless the goods are faulty, damaged, incorrect or we expressly agree otherwise. We recommend using a tracked and appropriately insured service, as you are responsible for the return until it reaches the designated return address.
We will reimburse the purchase price together with any initial standard delivery costs originally paid by you during your order. If your order qualified for complimentary shipping, no initial delivery costs were paid and therefore no delivery costs will be reimbursed. You are responsible for the cost of returning the goods.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having returned them, whichever occurs first.
Reimbursement will be made without undue delay and no later than 14 days after the day on which you inform us of your withdrawal. We will use the same payment method used for the original transaction unless expressly agreed otherwise. You will not incur a fee from us for the reimbursement.
You may inspect the product as you would in a physical shop. You are responsible for any diminished value resulting from handling beyond what is necessary to establish the product’s nature, characteristics and functioning.
10. Exceptions to the right of withdrawal
The statutory right of withdrawal does not apply where an exception under applicable law applies, including goods made to your specifications or clearly personalised goods.
Any applicable exception will be clearly communicated on the relevant product page before purchase.
11. Faulty, damaged or incorrect products
Please inspect your order after delivery and contact us promptly at hello@thetolme.com if a product is faulty, damaged in transit or different from what you ordered. Please include your order number and, where reasonably possible, photographs showing the issue and packaging.
Your products are protected by the mandatory legal guarantee applicable within the European Union. If a product does not conform to the contract, you may be entitled to have it brought into conformity through repair or replacement, free of charge, or, where the legal conditions are met, to receive a proportionate price reduction or terminate the contract.
Nothing in these Terms excludes or restricts your mandatory legal rights. Any commercial warranty offered by TÓLME or a manufacturer is additional to those rights.
12. Product care and intended use
Products must be used and cared for in accordance with the instructions supplied with the product and the information on the relevant product page.
Unless a product is expressly identified as waterproof or assigned a suitable IP rating, it must not be exposed to rain, standing water or excessive moisture. A TÓLME lamp may accompany you outdoors where stated on the product page, but a product that is not certified as waterproof must not be left outside in rain and should be wiped dry and stored in a dry place after use.
Damage caused by misuse, accidents, failure to follow care or safety instructions, unauthorised modification, or ordinary wear and tear is not a lack of conformity for which we are responsible, except to the extent otherwise required by law.
13. Promotions and discount codes
Promotions, discounts and discount codes may be subject to additional conditions communicated with the relevant offer. Unless stated otherwise, discount codes cannot be combined, exchanged for cash or applied retrospectively.
Promotions do not affect your statutory rights.
14. Intellectual property
The Store and its original content, including the TÓLME name, logos, product names, copy, photographs, graphics, videos and design elements, are owned by or licensed to Rédey Viktoria Desirée e.v. and are protected by applicable intellectual property laws.
You may access and use the Store for personal, non-commercial purposes. You may not reproduce, distribute, modify, republish or commercially exploit Store content without prior written permission, except where permitted by law.
15. Reviews and submitted content
If you voluntarily submit a review, image or other content to us, you confirm that you have the right to do so and that the content does not infringe the rights of another person or contain unlawful or misleading material.
You grant us a non-exclusive, worldwide, royalty-free licence to display and reproduce that content for the operation and promotion of TÓLME. This licence does not transfer ownership of your content to us. Where legally required, we will obtain any additional consent before using identifiable personal content for marketing.
We may decline or remove submitted content where reasonably necessary, including if it is unlawful, abusive, irrelevant, misleading or infringes third-party rights.
16. Third-party services and links
The Store may contain links to, or functions provided by, third parties such as Shopify, payment providers and delivery companies. We are not responsible for third-party websites that we do not operate. Your use of those services may be subject to the relevant third party’s terms and privacy notice.
This section does not limit our responsibility for the performance of the sales contract or any liability that cannot lawfully be excluded.
17. Liability
We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.
We are not responsible for:

loss or damage that was not a foreseeable result of our breach;

business losses incurred by a consumer, including loss of profit, revenue or business opportunity; or
-
delay or failure caused by an event outside our reasonable control, provided that we comply with our legal obligations in such circumstances.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability under mandatory product-safety and consumer-protection law.
18. Personal data
We process personal data in accordance with our Privacy Policy. Because the Store is hosted by Shopify, Shopify and service providers involved in payment, fulfilment and delivery may process personal data as described in that policy.
Please read the Privacy Policy before placing an order.
19. Governing law, complaints and disputes
These Terms and contracts concluded through the Store are governed by Hungarian law. If you are a consumer residing in another European Union country, this choice does not deprive you of the protection of mandatory consumer-law provisions applicable in your country of residence.
Please send complaints to hello@thetolme.com. We will endeavour to resolve them directly and respond within the period required by applicable law.
You may also have access to an authorised consumer alternative dispute resolution body. Information about the competent Hungarian consumer conciliation body and its procedure is provided in our Legal Notice or complaints information, where applicable.
You may bring proceedings in the courts competent under applicable consumer law. Nothing in this section restricts a consumer’s right to bring a claim in the courts of their country of residence where that right applies.
20. Changes to these Terms
We may update these Terms from time to time, including to reflect changes to the Store, our business or applicable law. The version that applies to your purchase is the version in force when you place your order.
The current version will be available in the Store together with its last-updated date.
